TERMS AND CONDITIONS OF USE - TRAZAVIA

These Terms and Conditions of Use regulate the access and utilization of the mobile application and associated services ofTrazavia(hereinafter, "the Application"). By creating an account, downloading, or using Trazavia, you acquire the status of User (hereinafter, "the User") and imply full, express, and unreserved acceptance of every clause detailed herein. If you do not agree with these terms, you must refrain from using the Application.

1. Service Status (Beta Phase)

The Trazavia Application is currently in a testing, evaluation, and early-development phase (Beta / testing phase), operating under the trade name Trazavia. During this stage, the service is provided free of charge for purely demonstrative and informational purposes.

2. Purpose and Description of the Service

Trazavia is a platform oriented towards the off-road and trail exploration community, whose main features include:

• Visualization of mapping layers (trail networks, cadastral data, protected natural spaces, cattle trails, among others).
• Orientation, navigation, and GPS trace recording tools (tracking).
• Community features to share routes, points of interest (POIs), and reports regarding terrain status.
• Informational notices about motor-vehicle access restrictions that may affect routes (access alerts).

The Application is currently provided free of charge. No fee is charged to use the core features. Optional advertising may be shown to help cover infrastructure costs. If paid plans or subscriptions are introduced in the future, they will be clearly disclosed and governed by separate or updated terms before any charge applies.

3. Disclaimer of Liability and Prevalence of Reality

The cartographic information, tracks shared by other users, and data displayed on Trazavia (including boundaries of protected spaces or trail typologies) are providedstrictly for informational and orientational purposes.

• Driver Responsibility: The User is solely responsible for driving their vehicle, assessing real-world terrain safety, and respecting traffic and safety regulations at all times.
• Prevalence of Reality: Actual physical conditions on the ground (landslides, weather, changes in road ownership, physical "No Entry" signs, or private property notices) absolutely override any virtual information shown in the Application.
• Environmental Regulations and Fines: The User commits to knowing and strictly abiding by state, regional, and local legislation governing motorized access to the natural environment (such as Forestry Laws and specific regulations for protected areas). Trazavia is not liable under any circumstances for administrative sanctions (fines) or damages resulting from illegal transit through restricted tracks.
• Service Warranty: To the fullest extent permitted by law, Trazavia disclaims liability for property loss, vehicle damage, bodily accidents, or rescue costs resulting from following a route or track viewed within the platform.
• Mandatory Rights Preserved: Nothing in these Terms excludes or limits mandatory consumer rights, nor liability for willful misconduct or gross negligence where such limitation would be unlawful.

4. Access Restriction Notices

Trazavia may display notices about motor-vehicle access restrictions on forest tracks and similar routes (for example at national, regional, or local level). This feature is part of the Application's informational services.

These notices arestrictly an informational service and are not infallible. In particular:

• Trazavia is not a public authority, official body, or government agency of any kind, and does not act on behalf of any administration. It does not issue official authorizations, prohibitions, or certifications regarding access.
• Access restriction notices may be incomplete, outdated, inaccurate, delayed, or missing. The absence of a notice does not mean that access is permitted, and the presence of a notice does not replace verification against official sources.
• Applicable law, official publications, physical signage on the ground, and communications from the competent authorities always prevail over any information shown in the Application.
• The User is solely and exclusively responsible for checking, before and during any trip, whether access is legally allowed; for complying with all applicable regulations; and for any consequence of relying on these notices (including fines, sanctions, denial of access, damages, or other liabilities).
• By using the Application, the User accepts that Trazavia assumes no liability for decisions, routes, or conduct based on these informational notices.

5. Route Planner (Experimental Phase)

Trazavia offers a route planner that suggests itineraries based on preferences and filters set by the User. This feature is currently in an experimental phase.

The planner's algorithm does not authorize, certify, or guarantee legal access to any route. Itonly combines the User's requirements with information drawn from the national state road and path database(and other cartographic sources used by the Application). In particular:

• Experimental status: Results may be inaccurate, incomplete, change without notice, or be unavailable. The feature may be modified or withdrawn at any time.
• Informational nature: Suggested routes are proposals for orientation only. They do not constitute professional, legal, administrative, or official advice of any kind.
• Trazavia is not a public authority, official body, government agency, or legal institution of any kind, and does not act on behalf of any administration.
• The national database and other sources may be incomplete, outdated, or not reflect current physical conditions, signage, or applicable regulations.
• The User is solely and ultimately responsible for verifying that any planned or followed route complies with all applicable laws and regulations, for obtaining any required permits, and for any consequence of using the planner (including fines, sanctions, denial of access, damages, or other liabilities). By using the planner, the User accepts that Trazavia assumes no liability for itineraries generated, followed, or shared based on this experimental feature.

6. User Obligations and Behavior

When using Trazavia's community features, the User expressly agrees to:

• Provide truthful information and maintain the security of their access credentials.
• Not publish, record, or publicly share routes that clearly cross fenced private properties, restricted military access zones, strict ecological exclusion areas, or trails where motorized passage is legally prohibited.
• Not upload content (profile pictures, comments, or reports) that is offensive, illegal, unauthorized advertising, or infringes third-party intellectual property rights.
• Not abuse reporting tools, scrape or harvest data unreasonably, attack or disrupt the service, or reverse-engineer the Application beyond what applicable law permits; and to cooperate reasonably with notices concerning allegedly illegal content.

7. User Content and Illegal Content Notices

Users are responsible for the content they upload, publish, or share through the Application (user-generated content).

• Trazavia may remove, restrict, or disable access to content that appears illegal, infringes these Terms, or harms the integrity of the community or the service.
• To report allegedly illegal content, send a notice to our support email at[email protected]describing the content and the reasons for the report. We will review notices in a reasonable time and take action we consider appropriate.

8. Intellectual Property

• Application Content: The designs, interfaces, logos, source code (backend and frontend), cartographic systems, and optimization algorithms of Trazavia are the exclusive property of its developers and are protected by international intellectual property laws.
• User Content: By recording or publishing a GPS track publicly to the community, the User grants Trazavia a free, non-exclusive, transferable, worldwide license to host, process, and display such cartographic information for the benefit and use of the rest of the user community.

9. Third-Party Maps and Data

The Application may display or rely on third-party maps and data sources, including Mapbox for maps and related services, cadastral, OpenStreetMap, or other public cartographic sources, and Open-Meteo for weather or elevation information.

• Such information is provided for informational and orientational purposes only and may be incomplete or outdated.
• Attributions required by those providers may appear in the Application or related documentation. Use of those services may also be subject to the providers’ own terms.

10. Modification and Termination of Services

We reserve the right to modify, suspend, or terminate temporarily or permanently any functionality of the Application. Furthermore, we reserve the right to immediately cancel or suspend access to accounts of Users who repeatedly or seriously violate these Terms and Conditions, without prior notice and without granting any right to compensation.

Material changes to these Terms will be notified through the Application and/or by email when feasible. Continued use of the Application after the effective date of the updated Terms constitutes acceptance of the changes. If you do not agree, you must stop using the Application and may delete your account.

11. Minors

The Application is not directed at persons under 16 years of age. If you are under 16, you must not register or use the service without the authority of a parent or legal guardian as required by applicable law.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with Spanish legislation. For consumers, mandatory consumer jurisdiction rules apply and, where required by law, the consumer may bring proceedings before the courts of their domicile. For non-consumers, the parties submit to the Courts and Tribunals of Castellón, Spain, without prejudice to any mandatory rules that may apply.

13. Language and Severability

These Terms may be made available in several languages. For Users in Spain, or in case of conflict between translations, the Spanish version prevails.

If any clause of these Terms is held invalid or unenforceable, the remaining clauses shall continue in full force and effect.
