These Terms and Conditions of Use regulate the access and utilization of the mobile application and associated services of Trazavia(hereinafter, "the Application"). By creating an account, downloading, or using Trazavia, you acquire the status of User (hereinafter, "the User") and imply full, express, and unreserved acceptance of every clause detailed herein. If you do not agree with these terms, you must refrain from using the Application.
1. Purpose and Description of the Service
Trazavia is a platform oriented towards the off-road and trail exploration community, whose main features include:
- Visualization of mapping layers (trail networks, cadastral data, protected natural spaces, cattle trails, among others).
- Orientation, navigation, and GPS trace recording tools (tracking).
- Community features to share routes, points of interest (POIs), and reports regarding terrain status.
2. Disclaimer of Liability and Prevalence of Reality
The cartographic information, tracks shared by other users, and data displayed on Trazavia (including boundaries of protected spaces or trail typologies) are provided strictly for informational and orientational purposes.
- Driver Responsibility: The User is solely responsible for driving their vehicle, assessing real-world terrain safety, and respecting traffic and safety regulations at all times.
- Prevalence of Reality: Actual physical conditions on the ground (landslides, weather, changes in road ownership, physical "No Entry" signs, or private property notices) absolutely override any virtual information shown in the Application.
- Environmental Regulations and Fines: The User commits to knowing and strictly abiding by state, regional, and local legislation governing motorized access to the natural environment (such as Forestry Laws and specific regulations for protected areas). Trazavia is not liable under any circumstances for administrative sanctions (fines) or damages resulting from illegal transit through restricted tracks.
- Service Warranty: Trazavia disclaims any liability for property loss, vehicle damage, bodily accidents, or rescue costs resulting from following a route or track viewed within the platform.
3. User Obligations and Behavior
When using Trazavia's community features, the User expressly agrees to:
- Provide truthful information and maintain the security of their access credentials.
- Not publish, record, or publicly share routes that clearly cross fenced private properties, restricted military access zones, strict ecological exclusion areas, or trails where motorized passage is legally prohibited.
- Not upload content (profile pictures, comments, or reports) that is offensive, illegal, unauthorized advertising, or infringes third-party intellectual property rights.
4. Intellectual Property
- Application Content: The designs, interfaces, logos, source code (backend and frontend), cartographic systems, and optimization algorithms of Trazavia are the exclusive property of its developers and are protected by international intellectual property laws.
- User Content: By recording or publishing a GPS track publicly to the community, the User grants Trazavia a free, non-exclusive, transferable, worldwide license to host, process, and display such cartographic information for the benefit and use of the rest of the user community.
5. Modification and Termination of Services
We reserve the right to modify, suspend, or terminate temporarily or permanently any functionality of the Application. Furthermore, we reserve the right to immediately cancel or suspend access to accounts of Users who repeatedly or seriously violate these Terms and Conditions, without prior notice and without granting any right to compensation.
6. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with Spanish legislation. For any controversy, litigation, or claim arising from the access or use of the Application, the parties expressly submit to the competent Courts and Tribunals of the city of Castellón, Spain, expressly waiving any other jurisdiction that might correspond to them.
